Preet! Preet! Preet!


“We simply want people in high office to stop violating the law...People elected to make laws should not be breaking them.”






Phew, Lots of goings on in state politics New York in the last week. Last Friday, the citizens of my fair state woke to photos splashed all over the papers of Sheldon Silver, venerable and all-powerful Speaker of the Assembly, being led away in handcuffs. Thanks to the investigation headed by the US Attorney of the Southern District of New York Preet Bharara who took up the gauntlet when it was abuptly dropped by Gov. Andrew Cuomo, Mr. Silver has been charged with five counts of crimes against of the citizens of New York including allegedly "us[ing] the power and influence of his official position to obtain for himself millions of dollars masked as legitimate income earned...as a private lawyer" and "knowingly did combine, conspire, confederate...to willfully and knowingly obstruct, delay, and affect in any way and degree commerce...by extortion..."

In his press conference after the Silver arrest, Bharara ended with this:
"These charges in our view go to the very core of what ails Albany: lack of transparency, lack of accountability, and lack of principle — joined with overabundance of greed, cronyism, and self-dealing. But we will keep at it. As our unfinished fight against public corruption continues, you should stay tuned."
Silver was elected to the state assembly to represent lower Manhattan in 1977 and proceeded to gain more and more power and influence culminating in his appointment as Speaker of the Assembly in 1994 and a position he has held for 20 years until this week. Mr. Silver has spent his time in the Assembly gaining more and more power until he is now the most influencial Democrat in the state of New York. He has also spent his time making himself a very wealthy man. While serving as our esteemed Speaker, he has also been on the payroll of one the most influential and powerful plaintiff products liablility law firms in the state. Though he diligently reported some of the millions he was paid by this firm on his mandated yearly disclosure forms, he refused to answer questions as to what he did to earn his millions claiming that it would compromise his "client/attorney" privilege to divulge that information. This is important in that a simple docket search yielded only one case in which Mr. Silver was listed as the attorney of record. Oh, and this is kind of important too - he has spent much time blocking any kind of tort reform legislation in the state.


As I have written about before, we have a problem with "ethics" in our state legislature. So much of a problem that 22 elected officials have been indicted, tried, and jailed in the last 10 years and a Governor who was forced to resigned because of his taste for transporting prostitutes across state line for the purpose of...well, I don't really have to spell it out, do I? This is where Governor Cuomo's problems enter in. When Cuomo was elected as our governor, he promised to clean up Albany. It took him a while, but in early 2014, Cuomo invoked his governorly duties by appointing a commission of hand-picked members to investigate the ethics and corruption in our state government. The Moreland Commission, as it was called began diligently investigating any allegations of unethical behavior and asking questions, lots of questions. However, when their investigation began to close in on Speaker Silver with multiple subpoenaes, and little too close to the Governors office, Governor Cuomo abruptly quashed the Commission. His public excuse was that he had stuck some vague deal with Mr. Silver and the Legislature that they would pass new ethics laws real soon. Interestingly, Cuomo quashed his own commission right before the 2014 general elections.

Well, this came to the attention of our intrepid US Attorney Preet Bharara who smelled a rat. He asked the Commission to turn over all their files to his office which they did and his office started their own investigation. During their investigation, they discovered that not only was Mr. Silver on the payroll of one highly influencial law firm, he also had not disclose that he was kicking back a "finders fee" to a prominent Oncologist to direct his patients to the law firm. And this prominent Oncologist was awarded $500,000 in research grants from the taxpayers awarded by the very generous...Mr. Silver. What a coikidink! Then it was discovered during the investigation that Mr. Silver had failed to disclose more millions that he was paid by another law firm. This firm was an influencial real estate that brokered real estate transaction that came with huge tax rebates from the state. Transactions that were directed to the law firm by...Mr. Silver. Oops, but it was just a clerical error...no, he just forgot about those millions.

Silver isn't going down without a fight. While in closed meetings with his fellow Assembly Democrats this week he tried his hardest to make a deal that he wouldn't have to actually resign, but maybe just appoint a 5-person "committee" of hand-picked cronies who could just take over temporarily until he could be fully exonerated of all of the scurrilous charges and resume his powerful post. That did not fly so well and he has been forced to resign his post effective Monday.

Preet Bharara did not file these charges lightly and he knows what he is doing. And if he is successful which I have every confidence he will be, Silver will most likely go to prison and hopefully lose his state funded pension and Governor Cuomo will have to answer questions as to what he knew about all of this, when he knew about it and why he disbanded his own Commission when it was obvious what Mr. Silver had been up to all these years. Bharara has indicated to a very nervous Albany that he has "a number of public corruption investigations going on", so stay tuned.

Snow-maggedon Day!

For days we have been preparing for the blizzard of the decade. Even as I write, I received an alert on my smartphone warning that the all non-emergency vehicles must be off the roads by 11pm tonight until further notice. All public transportation began shutting down at 8pm and as of one minute ago, the bridges and tunnels have been shut down until further notice. The snow is expected to continue throughout the night and accumulate to up to 33 inches in Manhattan.

As always happens with pending disasters in NYC, throughout the weekend, the lines at the grocery stores have been around the block and all of the shelves have been emptied of bread and milk [though I did score a 1/2 gallon of 2% at the last minute! Woo-hoo!]. Don't get me wrong, I take these things very seriously as we all should, but one would think that we are the Donner Party preparing to be stranded in the wilderness for months. I expect from the way people are reacting in NYC, that if we are not fully supplied with a pantry full of sugary (or savory) snacks at the ready, there will be city-wide acts of cannibalism by noon tomorrow!

And can someone explain to me why one needs to buy gallons of bottled water for a snow event when a) the water is still flowing right out of the tap (just fill up a few pots if you feel you need it); and b) isn't snow made of frozen water that melts into liquid water? Okay, okay, I am sounding like a Manhattan-ite and an urban snob who lives in an apartment building. I realize that outside of Manhattan, the chances of a power outages especially on Long Island where the power lines are above ground are almost certain, but come on.

So that we can all not panic too much, here are few tips to be prepared and things you should have done by now:

1. Power up all the electronics now. If you have an external battery supply make sure that is powered up too.
2. Make sure the flashlights and emergency radios have batteries
3. Make sure you have enough of any medications
4. Fill up your car and any generators with the appropriate fuel.
5. Bring your pets inside!
5. Check on elderly or disabled neighbors and make sure they have what they need.
6. If you have babies or other children...well, you know what to do.
7. Other stuff I can't think of right now

By the way, if you have a smartphone, you can get alerts through your local and state emergency preparedness office. It find it is very handy.

So, while I hunker down preparing to fight off cannibals, snow-zombies, and certain starvation, let me know how you prepare for emergencies.

As an aside: You will not hear me say this often, but Mayor de Blasio is handling this really well. He has taken control and made the decisions that are appropriate in shutting the ;ublic transportation, streets, bridges and tunnels down to all but emergency vehicles. It proves he can learn.

SOTU #7 - Open Thread

Tonight we will hear the 7th State of Union Address from our President. And for the alst few weeks, he has been traveling around some of those 57 states trying to sell his 7th year agenda which interestingly does not seem to involve the new Republican-led Congress much. Let's see, from the Whitehouse.gov site "teasers", we can expect some of the following:

1. The overwhelming success of Obamacare;
2. The success of the economic recovery (the website touts the biggest recovery since the 1990's with a chart and all!);
3. Something about free Community College for all;
4. Raising taxes on the rich and giving tax breaks to the middle class;
5. Something about "Wall Street";
6. Introducing all the guests of First Lady Michelle, most of whom will be Obamacare success stories;
7. Something about "he hopes he has the opportunity to work with the new Congress...yada, yada, yada";
8. And all of the executive actions he will sign when he can't work with Congress;
9. Univeral high speed internet and Net Neutrality (which I still don't understand);
10. More free stuff he wants to give to the American people;
11. How the world is a much safer place since 2009;
12. Ending the War in Afghanistan (you know that happened, right?);
13. How hard he will work to work with Congress to pass comprehensive Immigration legislation (or if not, by more executive orders);
14. Easing relations with Cuba;

Stuff he probably won't mention -
1. Global terrorism, though I expect he will say something about the recent "workplace violence" in Paris;
2. Ebola;
3. The $18 trillion debt which has grown from $10.5 trillion in 7 years;
4. How much he is looking forward to working with the new leadership in Congress.

Martin Luther King Jr. On His Birthday

Martin Luther King Jr. was born in Atlanta, Georgia on January 15, 1929. On Monday, we observe a federal holiday dedicated to Dr. King, but on his real birthday, let's take a moment to observe his words. Let us celebrate how far we have come and remind ourselves how far we all still need to go to make a better world for all people.



At the March on Washington for Jobs and Freedom on August 28, 1963, Dr. King gave this immortal speech before 250,000 people while standing in front of the Lincoln Memorial...
I am happy to join with you today in what will go down in history as the greatest demonstration for freedom in the history of our nation.

Five score years ago, a great American, in whose symbolic shadow we stand today, signed the Emancipation Proclamation. This momentous decree came as a great beacon light of hope to millions of Negro slaves who had been seared in the flames of withering injustice. It came as a joyous daybreak to end the long night of their captivity.

But 100 years later, the Negro still is not free. One hundred years later, the life of the Negro is still sadly crippled by the manacles of segregation and the chains of discrimination. One hundred years later, the Negro lives on a lonely island of poverty in the midst of a vast ocean of material prosperity. One hundred years later, the Negro is still languished in the corners of American society and finds himself an exile in his own land. And so we've come here today to dramatize a shameful condition.

In a sense we've come to our nation's capital to cash a check. When the architects of our republic wrote the magnificent words of the Constitution and the Declaration of Independence, they were signing a promissory note to which every American was to fall heir. This note was a promise that all men -- yes, black men as well as white men -- would be guaranteed the unalienable rights of life, liberty, and the pursuit of happiness.

It is obvious today that America has defaulted on this promissory note insofar as her citizens of color are concerned. Instead of honoring this sacred obligation, America has given the Negro people a bad check, a check that has come back marked "insufficient funds."

But we refuse to believe that the bank of justice is bankrupt. We refuse to believe that there are insufficient funds in the great vaults of opportunity of this nation. And so we've come to cash this check, a check that will give us upon demand the riches of freedom and security of justice. We have also come to his hallowed spot to remind America of the fierce urgency of now. This is no time to engage in the luxury of cooling off or to take the tranquilizing drug of gradualism. Now is the time to make real the promises of democracy. Now is the time to rise from the dark and desolate valley of segregation to the sunlit path of racial justice. Now is the time to lift our nation from the quicksands of racial injustice to the solid rock of brotherhood. Now is the time to make justice a reality for all of God's children.

It would be fatal for the nation to overlook the urgency of the moment. This sweltering summer of the Negro's legitimate discontent will not pass until there is an invigorating autumn of freedom and equality. 1963 is not an end but a beginning. Those who hoped that the Negro needed to blow off steam and will now be content will have a rude awakening if the nation returns to business as usual. There will be neither rest nor tranquility in America until the Negro is granted his citizenship rights. The whirlwinds of revolt will continue to shake the foundations of our nation until the bright day of justice emerges.

But there is something that I must say to my people who stand on the warm threshold which leads into the palace of justice. In the process of gaining our rightful place we must not be guilty of wrongful deeds. Let us not seek to satisfy our thirst for freedom by drinking from the cup of bitterness and hatred. We must forever conduct our struggle on the high plane of dignity and discipline. We must not allow our creative protest to degenerate into physical violence. Again and again we must rise to the majestic heights of meeting physical force with soul force. The marvelous new militancy which has engulfed the Negro community must not lead us to a distrust of all white people, for many of our white brothers, as evidenced by their presence here today, have come to realize that their destiny is tied up with our destiny. And they have come to realize that their freedom is inextricably bound to our freedom. We cannot walk alone.

As we walk, we must make the pledge that we shall always march ahead. We cannot turn back. There are those who are asking the devotees of civil rights, "When will you be satisfied?" We can never be satisfied as long as the Negro is the victim of the unspeakable horrors of police brutality. We can never be satisfied as long as our bodies, heavy with the fatigue of travel, cannot gain lodging in the motels of the highways and the hotels of the cities. We cannot be satisfied as long as the Negro's basic mobility is from a smaller ghetto to a larger one. We can never be satisfied as long as our children are stripped of their selfhood and robbed of their dignity by signs stating "for whites only." We cannot be satisfied as long as a Negro in Mississippi cannot vote and a Negro in New York believes he has nothing for which to vote. No, no we are not satisfied and we will not be satisfied until justice rolls down like waters and righteousness like a mighty stream.

I am not unmindful that some of you have come here out of great trials and tribulations. Some of you have come fresh from narrow jail cells. Some of you have come from areas where your quest for freedom left you battered by storms of persecution and staggered by the winds of police brutality. You have been the veterans of creative suffering. Continue to work with the faith that unearned suffering is redemptive.

Go back to Mississippi, go back to Alabama, go back to South Carolina, go back to Georgia, go back to Louisiana, go back to the slums and ghettos of our northern cities, knowing that somehow this situation can and will be changed.

Let us not wallow in the valley of despair. I say to you today my friends -- so even though we face the difficulties of today and tomorrow, I still have a dream. It is a dream deeply rooted in the American dream.

I have a dream that one day this nation will rise up and live out the true meaning of its creed: "We hold these truths to be self-evident, that all men are created equal.

I have a dream that one day on the red hills of Georgia the sons of former slaves and the sons of former slave owners will be able to sit down together at the table of brotherhood.

I have a dream that one day even the state of Mississippi, a state sweltering with the heat of injustice, sweltering with the heat of oppression, will be transformed into an oasis of freedom and justice.

I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.

I have a dream today.

I have a dream that one day down in Alabama, with its vicious racists, with its governor having his lips dripping with the words of interposition and nullification -- one day right there in Alabama little black boys and black girls will be able to join hands with little white boys and white girls as sisters and brothers.

I have a dream today.

I have a dream that one day every valley shall be exalted, and every hill and mountain shall be made low, the rough places will be made plain, and the crooked places will be made straight, and the glory of the Lord shall be revealed and all flesh shall see it together.

This is our hope. This is the faith that I go back to the South with. With this faith we will be able to hew out of the mountain of despair a stone of hope. With this faith we will be able to transform the jangling discords of our nation into a beautiful symphony of brotherhood. With this faith we will be able to work together, to pray together, to struggle together, to go to jail together, to stand up for freedom together, knowing that we will be free one day.

This will be the day, this will be the day when all of God's children will be able to sing with new meaning "My country 'tis of thee, sweet land of liberty, of thee I sing. Land where my father's died, land of the Pilgrim's pride, from every mountainside, let freedom ring!

And if America is to be a great nation, this must become true. And so let freedom ring from the prodigious hilltops of New Hampshire. Let freedom ring from the mighty mountains of New York. Let freedom ring from the heightening Alleghenies of Pennsylvania.

Let freedom ring from the snow-capped Rockies of Colorado. Let freedom ring from the curvaceous slopes of California.

But not only that; let freedom ring from Stone Mountain of Georgia.

Let freedom ring from Lookout Mountain of Tennessee.

Let freedom ring from every hill and molehill of Mississippi -- from every mountainside.

Let freedom ring. And when this happens, and when we allow freedom ring -- when we let it ring from every village and every hamlet, from every state and every city, we will be able to speed up that day when all of God's children -- black men and white men, Jews and Gentiles, Protestants and Catholics -- will be able to join hands and sing in the words of the old Negro spiritual: "Free at last! Free at last! Thank God Almighty, we are free at last!"

More News About Healthcare...

So, remember when our entire healthcare system was overhauled so that everyone could finally benefit from "preventative care"? Legislation was passed to require that all of our health insurance policies would provide "free" annual exams because it would make us all healthier and would be less costly with all that early detection and stuff. Well, if you do, then this ought to interest you...

Perhaps you remember Ezekiel Emanuel, MD, He is the brother of current Chicago Mayor Rahm Emanuel who was also the former Chief of Staff to President Obama. And you may remember that Dr. Emanuel was one of the chief advisers who helped create the "Affordable Care Act" that would ovehaul our entire healthcare system. As part of the grand overhaul, it requires that said "free" annual exams would be provided by physicians and insurance companies at "no cost" to the patient.

Well, now Dr. Emanuel (brother of Rahm) has just offered his opinion that all those preventive exams are, in fact, a load of bunk. In his latest Op/Ed piece in the New York Times from Friday - Skip Your Annual Physical, he pretty much spells out how research shows that annual exams do nothing to help uncover or prevent chronic diseases such as heart disease or other chronic diseases. Instead of people dying in the streets for lack of available and adequate preventative care for which we just overhauled our entire healthcare system to correct, it turns out that two of the top "leading causes of death in Americans" are "uintentional injuries and suicides". So all of those routine tests that doctors put you through in those annual exams have no benefit except in the rare occasion that some underlying condition just happens to be discovered by accident. Yeah, you are more likely to die by accident that to have some disease diagnosed by accident.

Here is what he writes -

"Regardless of which screenings and tests were administered, studies of annual health exams dating from 1963 to 1999 show that the annual physicals did not reduce mortality overall or for specific causes of death from cancer or heart disease. And the checkups consume billions, although no one is sure exactly how many billions because of the challenge of measuring the additional screenings and follow-up tests."

Of course, like when they said doctors just did toncillectomies to increase revenue, according to Dr. Emanuel, they also have been pushing the whole bogus preventative care thing too. But as I recall (and correct me if I am wrong) we were told repeatedly by the pro-ACA'ers that if only everyone could get all those "preventative care" exams, then no one would ever need real healthcare again because doctors would catch all those expensive diseases and conditions before they became really expensive diseases and conditions and we would all be much healthier and happier and the Earth would begin to heal and Peace would break out and...oh, wait that was something else.

Anyway, so where before we had insurance that did not cover "preventative care" like "wellness" visits and gym memberships, it did cover much less likely catastrophic events like broken bones, cancer treatments and chronic illnesse. Now we are forced to pay for insurance mandated by the US Government that will fully cover worthless "preventative care", but barely cover the less likely really bad stuff. Help me to understand why anyone ever thought this was a good idea.

A Drawing Has Never Killed Anyone

In light of the yesterday's terrorist attack in France, let's take a moment to reflect. Twelve people were killed including four well-known cartoonists at satirical weekly Charlie Hebdo, who were in a staff meeting. These people spent their talents daring to satirize political leaders, religious leaders, and most importantly showed no fear satirizing Mohammed and Islam. Ironically, Stephane Charbonnier, editor in chief of Charlie Hebdo once quipped that "a drawing has never killed anyone." At this writing, the terrorist are still at large.

This isn't the first time I have written about cartoonists being targeted by Islamic terrorists Remember Molly Norris from her "Draw Mohammed Day" incident in 2010? Her call to pen was in response to a "South Park" episode that was scrapped by weak-kneed television executives who, maybe rightly, feared this kind of scenario.

To keep this all in perspective, here is list of terrorist attacks around the world since 2000. If you make to the bottom of this list, you may notice that attacks are only getting more frequent and the UN responds by declaring that the world must work to curtail...hate speech.

November 26, 2008 – Muslim extremists kill at least 166 people and wound numerous others in a series of coordinated attacks on India's financial capital, Mumbai. The government of India blamed Pakistan based militant group Lashkar-e-Taiba and stated that the terrorists killed/caught were citizens of Pakistan, a claim which the Pakistani government first refused but then accepted when given proof. Ajmal Kasab, one of the terrorists, was caught alive.

I know you all did very well. And I am almost certain that you learned all the answers to these questions in elementary school. Am I right? Well, did you know that Civics classes are no longer a basic requirement in most public schools? As a matter of fact, 39 states require only one class in government or civics to graduate. If you think this is scary, watch this short video made by a couple of student journalists included in this 2012 HuffPo article - 'Lunch Scholars' Of course, it was edited to include the best "wrong answers". But when one student was asked "Who is the Vice President?" and her answer was "bin Laden", I died a little inside. There should be no student in any public school who cannot answer that question correctly.

I really have not point here except, if our students do not know the basics of when, where, what, why and how our government works, how can we reasonably expect them to be able to protect and defend our Constitution?

When The Truth Isn't Good Enough, Just Lie!

You may have read the endless reams of articles about the little kerfuffle at Rolling Stone magazine last week. Here is a link to the original story published November 19 - A Rape On Campus:A Brutal Assault and Struggle for Justice at UVA by Sabrina Rubin Erdely.

It's a horrific story about a young freshman who was invited to a frat party and ended up being brutally gang raped by a group of frat brothers as part of some frat initiation. This horrific story spawned campus protests and caused the University Board to suspend all fraternity activities and issue a statement condemning the incident and any kind of campus sexual assault. Well, except that the story was not the least bit true. Yeah, it turns out that Ms. Erdely, in her zeal to find a victim to highlight and perpetators to condemn, failed to do what any credible journalist would do before accusing people of a horrific criminal act. She failed to do any kind of fact-checking at all. She took what this young woman said as the truth because she trusted her instincts and just ran with it. And so did the Rolling Stone editors. As a matter of fact, once someone bothered to actually check the facts and "discrepancies" in the article, it did not take long to find the story to be an almost complete fabrication. It caused a firestorm on Twitter and here is just one of many articles from the Washinton Post - The Full Demise Of Rolling Stone Rape Story on December 10.

Now this is really beside the point. It is Erdeley's explanation as to why she feels she has done nothing wrong that is truly disturbing. According to her...and I am paraphrasing here...so what if none of it was actually true. It COULD have been true and that is good enough because there is a rape culture on college campuses today that must be stopped. But of course, that begs the question that if this "rape culture" is so rampant, why does she have to resort to fabrications to make her point? But even more hideous were her condemnations of any who would dare to take umbrage with her fabrications and distortions and then accusing them of being "rape deniers" and "supporters of rape culture". And the inevitable accusations of "blaming the victim" except in this story, there WAS no victim. Well, except the young men who were falsely accused, of course. But then, that's okay because they COULD have done it.

Anyway, you can read all you want about this issue with a simple "google search" if you want, but I find it scary that seemingly credible "journalists" now have no qualms about printing lies if it furthers their narrative. We used to call that "fiction", but now it is "journalism". This is just one example of the slippery slide downward into some kind of Orwellian nightmare.

Oh, and if you really want to see scary, check out the same type of kerfluffle surrounding HBO "Girls" writer/actress Lena Dunham's autobiography Not That Kind Of Girl and John Nolte's investigation for Breitbart - LINK. In her case she alleges that she was raped by a conservative, Republican student named "Barry" while a student at Oberline College. But this time her false accusations may cause a pretty hefty libel suit...here's her "brave" excuse - Lena Dunham on Rape Backlash

Spend, Spend, Spend...

With all the other hysteria going around, Congress passed a $1.1 trillion budget to keep "The Government" open for a little while longer. And despite the all the fire-breathing Drudge headlines condemning the Republicans and Boehner for betraying us, it doesn't really look that way entirely. Like all federal spending budgets, it's got goodies for everyone especially politicians! Washington Post did a fairly good point-by-point breakdown of what it includes some interesting funding cuts. And like the title indicates they "did the skimming" so we don't have to!

Here are few of the points from the article that I am going to cut and paste mainly because I am too lazy to do anything else. You can read the whole article here - LINK

AFFORDABLE CARE ACT:
The law is still funded, but there's no new money for it. There's also no new ACA-related funding for the Internal Revenue Service and the Centers for Medicare and Medicaid Services, the two agencies most responsible for implementing the law. The bill also would cut the budget of the Independent Payment Advisory Board -- what Republicans have called "the death panel" -- by $10 million.

AFGHANISTAN:
Congress withholds funding for the Afghan government "until certain conditions are met," including implementing the bilateral security agreement reached with the United States.



Oh, this point is interesting. With all the calls for passing legislation to curtail all that "Citizen's United" campaign spending, our elected officials seem to just double-down (or triple or quadruple) the amount one can donate. This ought to set those anti-campaign spending advocates tongues a-wagging!

CAMPAIGN FINANCE:
The bill would dramatically expand the amount of money that wealthy political donors could inject into the national parties, drastically undercutting the 2002 landmark McCain-Feingold campaign finance overhaul. Bottom line: A donor who gave the maximum $32,400 this year to the Democratic National Committee or Republican National Committee would be able to donate another $291,600 on top of that to the party’s additional arms -- a total of $324,000, ten times the current limit. DODD-FRANK:
Democrats agreed to make some of the biggest changes yet to the 2010 financial regulatory reforms. In a deal sought by Republicans, the bill would reverse Dodd-Frank requirements that banks "push out" some of derivatives trading into separate entities not backed by the Federal Deposit Insurance Corporations. Ever since being enacted, banks have been pushing to reverse the change. Now, the rules would go back to the way they used to be. But in exchange, Democrats say they secured more money for the enforcement budgets at the Commodity Futures Trading Commission and the Securities and Exchange Commission.


This might be problematic for the anti-immigration crowd, but we can't just let the southern border states go broke taking care of Obama's new "migrant" children. And apparently we will be paying their home countries for the privilege...

IMMIGRATION:
The bill only funds the Department of Homeland Security, which oversees most immigration policy, until February. But negotiators gave new money for immigration programs at other federal agencies. There's $948 million for the Department of Health and Human Service's unaccompanied children program -- an $80 million increase. The program provides health and education services to the young migrants. The department also gets $14 million to help school districts absorbing new immigrant students. And the State Department would get $260 million to assist Central American countries from where of the immigrant children are coming.


Well, this is step in the right direction!

INTERNAL REVENUE SERVICE:
One of the GOP's favorite targets will see its budget slashed by $345.6 million. The nation’s tax agency also would be banned from targeting organizations seeking tax-exempt status based on their ideological beliefs.


Oh, no! This is really mean...
JOE BIDEN:
The legislation once again enacts a pay freeze for the vice president "and senior political appointees."


But the other Federal workers will get their raise, but no more music videos and Vegas conventions. And a military personnel with get the same payraise.

FEDERAL WORKER PAY (AND CONFERENCES):
The bill allows a 1 percent pay raise ordered by Obama to take effect in January. And the legacy of embarrassing spending scandals at federal agencies persist as Congress once again banned or put limits on certain conferences, official travel and some employee awards.

MILITARY PAY AND PERKS:
Military service members will receive a 1 percent pay increase next year. But there's a pay freeze for generals and flag officers. The bill also ends a five percent discount on tobacco and tobacco-related products sold at military exchanges.

VETERANS:
After a year of embarrassing scandals at the sprawling Department of Veterans Affairs, lawmakers are making good on promises to provide more money and oversight. There's a total of $159.1 billion in discretionary and mandatory spending. Of that, $209 million was added to address new costs related to the bipartisan veterans' reform bill passed last summer. The legislation calls for adding medical staff and expanding dozens of facilities. In order to specifically addressing the "wait list" scandal, the VA's inspector general is getting a $5 million budget increase to continue investigating lapses in patient care.


Well, anyway, here are some others:
- Cuts to food stamps, but white potatoes are now an official vegetable "eligible for purchase" with food stamps. Of course, why weren't they before now?
- Sadly, no money to save the sage-grouse, but there is money to save their habitat from further destruction. Poor sage-grouse...

- Official portraits of elected officials will now have to be out of pocket.
- Continue to fund Israel and will no longer fund the Palestinian Authority or Hamas.
- Oh, and you'll be able to get those cheaper incandescent bulbs for a little while longer...

Hillary Clinton 2016 Goes Country...

Oh, you've got to see this! I have no idea what demographic this was supposed to appeal to, but, WOW, this guy just single-handedly tanked his own budding singing career. This new country music-style video was just released by the Stand With Hillary 2016 Super PAC and...well, bless their hearts. [Translation: You are morons. Walk away from that guitar and we will never speak of this again]

I am speechless. If this is the way they think they will win the white, working class vote, then they need a new plan. Needless to say, it hasn't gone over too well at all. But the good news for anyone running against Hillary, SWH2016 is planning similar versions that target the Hispanic and millenial demographics.

Sadly, Hillary has all the money in the world (estimates range in the $1billion range) to spend on her as-yet undeclared 2016 Presidential bid. You see, she has to wait as long as she can to officially declare that she is running because, once she does, she will no longer be able to charge $300K a pop for her campaign speeches and no more free hummus either. Oh, yeah, those fees are made payable directly to the non-profit/tax deductible Clinton Foundation famous for its charitable good works.

But then again, the above isn't nearly as bad as the video produced for her 2008 campaign:

Chuck Schumer Must Be Running For Something...

You may have missed this during the hubbub of Thanksgiving, but New York Senator Charles "Chuck" Schumer (D/NY) dropped a little bomblet on his fellow Democrats.

In a post-Nov. 4 election drubbing, he made a speech at a National Press Club on Nov. 25, he had this to say...
"After passing the stimulus, Democrats should have continued to propose middle-class-oriented programs and built on the partial success of the stimulus, but unfortunately Democrats blew the opportunity the American people gave them," Schumer said. "We took their mandate and put all of our focus on the wrong problem—health care reform."

The third-ranking Senate Democrat noted that just about 5 percent of registered voters in the United States lacked health insurance before the implementation of the law, arguing that to focus on a problem affecting such "a small percentage of the electoral made no political sense."

The larger problem, affecting most Americans, he said, was a poor economy resulting from the recession. "When Democrats focused on health care, the average middle-class person thought, 'The Democrats aren't paying enough attention to me,' " Schumer said.

The health care law should have come later, Schumer argued, after Democrats had passed legislation to help the middle class weather the recession. Had Democrats pushed economic legislation, he said, "the middle class would have been more receptive to the idea that President Obama wanted to help them" and, in turn, they would have been more receptive to the health care law.

Schumer said he told fellow Democrats in the lead-up to the passage of the Affordable Care Act that it was the wrong time to pass the law.

"People thought—and I understand this—lots of people thought this was the only time to do this, it's very important to do. And we should have done it. We just shouldn't have done it first," he said. "We were in the middle of a recession. People were hurting and saying, 'What about me? I'm losing my job. It's not health care that bothers me. What about me?' … About 85 percent of all Americans were fine with their health care in 2009, mainly because it was paid for by either the government or their employer, private sector. So they weren't clamoring. The average middle-class voter, they weren't opposed to doing health care when it started out, but it wasn't at the top of the agenda."

Duh, ya' think, Chuck?? Oh, wait, but I thought it was going so well? But then again I can't say we didn't warn him...but...well, from his own words circa 2010, this is what he had to say...
"I am proud to support the historic Affordable Care Act – the 2010 health care reform bill that recently became law and will help over 30 million Americans, including almost 3 million uninsured New Yorkers to gain access to affordable health insurance.,."

Oh, he's just sad that his dream of replacing Harry Reid as Senate Majority Leader has been dashed and yeah, he's up for re-election in 2016. So we can understand how desperate he may be to distance himself from his vast mistakes. By the way, Chuck has been Chairman of the Senate Democratic Policy Committee since 2010, so he has been the key election strategist on the issues the Dems have been running on and responsible for the losing streak in the mid-term elections.

Open Thread - Riot Edition

Happy Holiday Season everyone? Did you have a good one? I have been out of touch with what is going on for the last week, but what the heck is going on? (Bear with me as I am having trouble typing with my Thanksgiving carving knife injury which is nothing so dramatic as Andrew's problem but it hurts!) What I can gather from reading the local newspapers is that protests are occuring all over the country. With Al Sharpton is fanning the flames of unrest because...well...that is what he does and President Obama is not helping to quell the flames because...well, that is what he seems to excel at. You have to admit that Obama does excel at pitting groups against each other and then stepping in to do...well...more to fan the flames of discontent. I mean, he is a seasoned "community organizer" after all.

I realize that this will be his legacy and what he has used his time to do. Civil unrest is his goal. But, with Al Sharpton as his wingman, what is the end game here? Does he really get off on cities burning, protests and civil unrest?

My opinion is that we should give Obama and Sharpton what they want. Police forces in the country are being too aggressive and should be reined in. Who needs low crime anyway. It is obvious to me that street criminals are just victims of their circumstances and should be treated as victims. Thugs are just "misunderstood" and it is the police that are the problem. Give them what they want and all will be better. We should just hug it out, right?

On the otherhand, I am a firm believer that we have to learn how bad things can get to realize how wrong mob rule can be. As we all know, laws are just for people who will respect them anyway. Obviously, only chumps respect the law, right? Yeah, it's the police that are the real problem.

Of course one can compare the current "unrest" to how the white, privileged class reacted to O.J. Simpson being acquitted of brutally murdering two people. You remember how we took to the streets and rioted after the injustice of the verdict was rendered then. Oh, wait...that didn't happen.

Anyway, maybe we can talk it out. Let's discuss.

Friday, the Ferguson grand jury will make their decision on whether to indict Officer Darren Wilson and the impending riot that will insue either way. I know that it may be cynical of me, but maybe this is Obama's way of distracting the country. Or maybe he has chosen this exact moment ot distract from the whole Obamacare/Jonathan Gruber fiasco just as the open enrollment is being rolled out once again with the same problems as before. Like I said, I am cynical. Since we don't know exactly what he will do, we can discuss it as he makes his grand, imperial announcement. Maybe we'll be surprised.

With respect to the notion that I can just suspend deportations through executive order, that’s just not the case, because there are laws on the books that Congress has passed — and I know that everybody here at Bell is studying hard so you know that we’ve got three branches of government. Congress passes the law. The executive branch’s job is to enforce and implement those laws. And then the judiciary has to interpret the laws.

There are enough laws on the books by Congress that are very clear in terms of how we have to enforce our immigration system that for me to simply through executive order ignore those congressional mandates would not conform with my appropriate role as president.

Maria Elena Salinas of Univision: Now I know that you have reduced, this is another concern on Twitter, the number of deportations of non-criminals. However, in 2012 more than 184,000 non-criminals were deported. In the spirit of your push for immigration reform, would you consider a moratorium on deportations of non-criminals? Obama: Well, I think it is important to remind everybody that, as I said I think previously, and I’m not a king. I am the head of the executive branch of government. I’m required to follow the law. And that’s what we’ve done. But what I’ve also said is, let’s make sure that we’re applying the law in a way that takes into account people’s humanity. That’s the reason that we moved forward on deferred action. Within the confines of the law we said, we have some discretion in terms of how we apply this law. The same is true with respect to the kinds of the length of time that people have to spend outside of the country when their spouses are already here for example.

And I know your administration took some steps last year to protect unintended undocumented immigrants from being deported. However many people say that those efforts weren’t enough. Obama: Well, look Jacky, this is something that I’ve struggled with throughout my presidency. The problem is that, you know, I’m the president of the United States. And what we’ve done is, obviously, pass the deferred action which made sure that the DREAMers, young people who were brought here and think of themselves as Americans, are American except for their papers, that they’re not deported.

Having said all that, we’ve kind of stretched our administrative flexibility as much as we can. And that’s why making sure we get comprehensive immigration reform done is so important.

September 17, 2013:
My job in the executive branch is supposed to be to carry out the laws that are passed. Congress has said, here’s the law when it comes to those who are undocumented, and they allocate a whole bunch of money for enforcement. But if we start broadening that, then essentially I would be ignoring the law in a way that I think would be very difficult to defend legally,” Obama said. “So that’s not an option. I do get a little worried that advocates of immigration reform start losing heart and immediately thinking, well, somehow there’s an out here — if Congress doesn’t act, we will just have the president sign something and that will take care of it, and we won’t have to worry about it. What I have said is that there is a path to get this done and that is through Congress.”

ABC News on November 16, 2014 while at the G20 Conference in Australia:
Jim Avila: Following up on immigration — in 2010, when asked by immigration reform advocates to stop deportations and act alone on providing legal status for the undocumented, you said, “I’m President, I’m not king. I can’t do these things just by myself.” In 2013, you said, “I’m not the emperor of the United States. My job is to execute laws that are passed.” Mr. President, what has changed since then? And since you’ve now had a chance to talk since July with your legal advisors, what do you now believe are your limits so that you can continue to act as president and not as emperor or king?

Obama: Well, actually, my position hasn’t changed. When I was talking to the advocates, their interest was in me, through executive action, duplicating the legislation that was stalled in Congress. And getting a comprehensive deal of the sort that is in the Senate legislation, for example, does extend beyond my legal authorities. There are certain things I cannot do. There are certain limits to what falls within the realm of prosecutorial discretion in terms of how we apply existing immigration laws.

We Landed On A Comet!

In the middle of all the stupid stuff going on, including the indignity of a certain woman with no discernable talent whatsoever parading naked all over the newspapers, we landed a spacecraft on a comet! Well, by "we" I mean, the European Space Agency not NASA. NASA doesn't do anything like this these days. Long gone are the days of grand Presidential challenges to explore the universe and reach for the stars. Nope, NASA has seen its shuttle fleet scuttled and has been reduced to hitchhiking to the International Space Station they built years ago. But that doesn't mean that we can't still marvel at others and their amazing feats of human ingenuity.

And an amazing feat it is. In 2004, the ESA shot a spacecraft called Rosetta and Philae, the lander decribed as "the size of a medium washing machine" into space to explore the surface of a comet 4 billion miles away. Think about that for a minute. Ten years ago, scientists, mathematicians, and engineers calculated with pinpoint accuracy, the trajectory of a piece of machinery blasted into space and managed to land it on the surface of a comet on November 12, 2014 - 10 years later and 4 billion miles away. It is astounding what humans can do when we put our minds to doing stuff that advances human knowledge.

One would think the world would be calling for a parade for these scientists, mathematicians and engineers, right? Well, not so fast. Watch this clip and at 1:40 you will see what happened that has feminists around the country shreaking and fainting in horror...



You thought you'd see a giant space bug or large-eyed alien peering into the camera? No, they were shreaking and fainting because of a shirt worn by Dr. Matt Taylor, one of leading mission scientist, during an interview as the lander was making its decent. The fabric of this offending shirt that made especially for Dr. Taylor by a female friend was a montage of large breasted, scantily=clad cartoon women. Nooooooo! Feminists far and wide took to Twitter decrying "Who cares what he has done. How dare he demean women this way!" and "That shirt has done more damage to little girls than anything ever and why they HATE science!"

So, instead of heralding another giant leap for mankind, it has devolved into a social media feminist rage-fest claiming "this is the sort of casual misogyny that stops women from entering certain scientific fields." Seriously. They so bullied this poor guy at the moment of his greatest achievement that he ended up having to give a tearful public apology days later. Not one of those fake "I am sorry you were offended" non-apologies that we have become so accustomed to these days, but a real honest and tearful mea culpa. And yet these same women who think he has set women back to the 1950's will swoon with delight at the bravery of a talentless imbecile as she objectifies women to down to their ample body parts - no brains needed. What a great example for little girls! This is exactly why I cannot and will never call myself a feminist.

Obamacare and those Stupid American Voters...

So what do the Democrats do when one of the architects of the Affordable Care Act admits that they pretty much had to lie to get the bill passed? No, they don't blame Bush...not this time. And what do the Democrats do when this same architect refers to them in terms of "the stupidity of the American voter"? Well, they blame the messenger Rich Weinstein. Who is this guy anyway?

Well, here's the story. Rich Weinstein, described as a "mildmannered investment adviser" from Philly, went on a mission to figure out why his insurance policy had been cancelled and his new improved ACA policy premiums had dramatically increased.
“When Obama said 'If you like your plan, you can keep your plan, period'—frankly, I believed him,” says Weinstein. “He very often speaks with qualifiers. When he said 'period,' there were no qualifiers. You can understand that when I lost my own plan, and the replacement cost twice as much, I wasn’t happy. So I’m watching the news, and at that time I was thinking: Hey, the administration was not telling people the truth, and the media was doing nothing!” - Bloomberg
Mr. Weinstein searched hours and hours of videos of "David Cutler, Zeke Emanuel, Jonathan Gruber and people like that" and listened to what they had to say. All he did was listen. Then he hit on this clip from ACA architect and MIT Professor Jonathan Gruber from a UPenn conference in September of 2013...



Did he just admit that the bill was purposely written is such a way that the CBO wouldn't be able score it as a tax? And did he just admit it was the lack of transparency that was the political key to getting the bill passed? Well, yes and they could do it because of the "stupidity of the American voter or whatever".

Needless to say, this video hit the Web-verse and has gone viral. Mr. Gruber realized he had been caught, so he went on Ronan Farrow's MSNBC show (the least watched show on TV) to explain that he spoke "off the cuff" and his remarks were "innappropriate". LINK

Mr. Weinstein says he has more video to refute the claim that Mr. Gruber's remarks were "off the cuff" gaffes. But Weinstein's over-arching issue was how did he, just a regular guy looking for information, manage to find all of this and not one journalist even tried? And I have to say he is right. With all the high-minded Woodward and Bernstein wannabe's out there looking for the gotcha moment, why didn't they track down these videos?

Though beside the point right now, the Supreme Court case that Farrow and Gruber are referring has been brought by several states that hinges on a small phrase that says "people qualify for tax credits to help pay insurance premiums when they buy a plan on an exchange “established by the state.” The dispute is whether the federal government can subsidize insurance when a state opts out of creating their own state run exchanges and whether that phrase were just a "typo" as Prof. Gruber describes them or a huge flaw that kills the federal exchanges and possibly the ACA.

And as an final point: When will it dawn on the Democrats and liberals that the stupid American voters of which Mr. Gruber is referring is them?

What Is Net Neutrality?

I am feeling "stupid" today. Maybe it's that new virus that scientists at Johns Hopkins Medical School and the University of Nebraska accidentally discovered or maybe I am just naturally stupid. But can someone explain "net neutrality" to me?

As our ever-pivoting President published today, he wants to focus his attention on "net neutrality" instead of...say...just about anything. Granted, my level of trust in this Administration has already gone into the negative numbers (as in -100%), but this just sounds like it is titled to do exactly the opposite of what he says it will do...

I apologize in advance that this message from whitehouse.gov makes your ears bleed, but it is blessedly short...

An Even More Interesting Open Thread and other scary stuff...

Halloween Tradition:
What is your tradition for Halloween? I remember as a kid, it was THE best holiday ever. Even better than Christmas morning. We got to run around the neighborhood demanding candy...CANDY...from all the adults...AND they have to give it to us or face the threat of a trick! It was the perfect extortion plan. What could be better than that? Okay, so you had to wear a scratchy costume with a stupid plastic mask that you couldn't really see through that could cause bodily harm that sometimes required...ugh...a sweater, but CAAAAANNNNDDDDYYY! And you could wear lots and lots of red lipstick and EYE SHADOW and adults couldn't say anything even if it was blue!!!

Thousands (well, it seemed like thousands) of children running willy-nilly from house to house conspiring as we went along as to which house was giving the best treats! And free CAAAANNNDDDYYY everwhere you went. And every once in while there would be that special house that gave out full-sized Hershey chocolate bars! Full-sized!!! Yeah, and then there would be those houses that gave out fruit (what was up with that?) that could have been laced with razor blades or homemade popcorn balls that might have been filled with dangerous poisons like vitamins, but who ate those anyway, right? It was glorious. Of course we always had to have dinner first, but who could eat when you knew...KNEW...that all you had do to was suffer through dinner and then...well...CAAAAAANNNNDDDYYYY was waiting just for the taking! Ah, fun times.

And what is better on Halloween than more stuff about Ebola:
You know the doctor in New York City who devoloped Ebola that caused Govs. Cuomo and Christie to institute that mandatory quarantine? Well, it appears that his voluntary quarantine was not as he orginally described. He said that he self-quarantined himself in his Harlem apartment taking his temperature, however, now it is being reported that was all a big lie. It turns out the cops checked his Metrocard activity and discovered his travel schedule. So I am sure that the bowling alley that had to be shut down for decontamination has a case to sue him. Let the games begin.

Oh, and the nurse who was forcibly detained at Liberty Airport in New Jersey and quarantined is now in Maine. Now,the Governor of Maine has taken action to mandate a mandatory quarantine in Maine. As would be expected, the nurse has filed suit because she has been treated unfairly. Is it so unreasonable to ask that those who have had direct exposure to actually be responsible enough to limit their field of exposure for 21 days just out a sense of sensible caution and not to cause general panic?

EBOLA and other headaches

I really did not want to have to discuss this again. But, are you panicked enough yet? Well, I'm not, but, if Govs Cuomo and Christie need an issue to rally the electorate...hey, who am I to judge. No doubt you have heard that Govs. Cuomo (D/NY) and Christie (R/NJ) conspired together to mandate a mandatory quarantine for anyone entering their respective atates who come from West Africa.

Firstly, I would think that common sense would say that if you have been in West Africa and been actively treating Ebola patients that volunarily limiting one's contact with the general public and travelling by subway should be limited for 21 days and that this should not be an unreasonble request. However, I am not sure exactly how state governors have the authority to mandate a quarantine since I would think that our airports fall under federal jurisdiction. [I mean, if Gov. Perry is condemned for being forced to activate his National Guard to protect his southern border, how is it that Govs Christie and Cuomo do not face the same criticism?] Though I understand that in election year, one with a political agenda must appear to be proactive and it may be politcal advantageous. But seriously, can't we do better than this?


A tent with no runnng water, no shower facility, and no other electronic capabilty other than a cellphone to communicate. What was Gov. Christie thinking? Is there anyone with a functioning brain actually in charge?

Oh, yeah, no one has brought this up, but I will. The CDC, that government body that is tasked with spending the taxpayers money to developing a solid protocol for combating real biological threats to humanity, would actually spend their time and valuable resources on issues other than fantasy threats like - Zombie preparedness And we wonder why our confidence in our goverment agencies is at an all time low and we are unprepared for any solid protocol for a real-life contagion. How much did this cost the taxpayers? I just wonder how much we paid for this? Is there any wonder why we have lost confidence in our government agencies and their preparedness?

To be accurate, both Governors have backed off their mandate to forcibly mandate a quarantine at the behest of President Obama. However, who is really in charge of the message? My panic is only that no one is willing to present a clear message.
